Cases of this nature come under the Occupiers’ Liability Act 1957. The Act states that the occupier or owner of the public place in which the slip, trip or fall occurs, has a duty of care to visitors, and therefore must ensure that they remain reasonably safe whilst using the premises (or land) for the purpose for which they are allowed to be there. This is not an absolute duty and no-one is liable for a pure accident or another person’s misadventure.
The same can be true even if you were not a lawful visitor. If you were trespassing on another person’s land and suffered an accident, you may still be able to claim for compensation. Under the Occupier’s Liability Act 1984, all occupiers or owners have a duty of care to all persons including unauthorised visitors.
